6 requirements in force for this company — 3 in regulation, 3 in buyer programs. The grade is where the record stands against them, and the scale moves when they do.
Each of these is worked through below — what the record shows, where it falls short, and the sources for both.
What the record shows
Founded in 1987 in Petaluma by Rachel and Andy Berliner and still family-owned, Amy's ships more than 210 million meals a year into over 50,000 stores, holds the #1 dollar share in organic frozen entrees, pizza, burritos, snacks, and ready-to-eat soups, and was named 2026 Organic Company of the Year — running on more than 100 million pounds of organic ingredients annually. 1 2 16
A B Corporation since December 2020, certified at 102.7 against the 80-point bar. The certification was formally challenged in 2022; B Lab required public disclosure and an early recertification review, conducted in 2024, which identified no additional issues and closed with no further action. The certification stands as of 2026 — scrutinized, and kept. 5 6 7
The renewable-energy position is real and dated: a 2022 power purchase from Ørsted's Sunflower Wind Farm covers roughly 30% of operations — about 14,000 MWh a year — toward a published goal of 100% renewable electricity by 2030, alongside rooftop solar at the Petaluma headquarters. 10 11
Packaging carries a stated destination: about 75% recyclable today, cartons certified 100% recycled paperboard, and a published goal of 100% recyclable or compostable packaging by 2030. 13
The 2022 labor chapter is resolved on the record: NLRB settlements fulfilled with back pay and manager training, the Cal/OSHA audit reduced on appeal to a single serious violation and a $6,825 fine, and the consumer boycott ended in June 2024 after workplace, wage, and health-insurance improvements. 7 8
The gap
The 2023 impact report claims a 35% annual reduction in greenhouse gas emissions. The claim names no scopes, no baseline, and no methodology, and no Scope 1, 2, or 3 inventory has been published anywhere in the record — the company's sustainability lead has said measurement focuses on what operations directly control rather than Scope 3 modeling. The buyer programs in Amy's own channels ask for the count: Amazon has required supplier emissions data since 2024, Target sets science-based-target goals for suppliers by spend, and Walmart's climate machinery is familiar ground — the wind purchase itself ran through Walmart's program. Based on available data, the claim exists and the count does not. 9 12 24 25 10
The threshold question
SB 261 names companies over $500 million doing business in California. Amy's reported $600 million in sales in 2020; the strongest recent estimate puts 2023–24 revenue near $466 million, after a plant closure and a 15% workforce reduction. The statute's first question — are you in scope? — is a number the public record does not currently hold. Enforcement is stayed, but the question does not expire with the stay. 3 4 20 21
The label under review
In February 2026 a watchdog filed a formal USDA complaint alleging the certifier's mark on 'made with organic ingredients' products implies more than the 70%-organic standard those products meet. A complaint is a question, not a verdict — but the newest impact report dates to 2023, so the record answering that question is three years old and thinning. 14 9
Rules that apply to you
The $500M threshold sits inside Amy's revenue range — $600M self-reported in 2020, ~$466M estimated for 2023–24. Direct applicability is undetermined on public data. Enforcement stayed by the Ninth Circuit November 2025; the voluntary docket ran through July 1, 2026. 20 21 3
No direct obligation — no revenue estimate approaches the $1B threshold. It arrives through buyers: in-scope reporters disclose value-chain emissions from 2027, assembled from supplier data requests. First Scope 1·2 reports deferred to November 10, 2026. 17 18 19
Whole Foods carries Amy's, and suppliers to Amazon subsidiaries are required to share carbon emissions data and set reduction goals, effective 2024. 24 16
What to do next
Each gap above has a type of work that closes it. We list that here for free. If you want the specific vendors, the order to do them in, and what each step is likely to cost, that comes with a paid plan — and we walk it with you.
Turns the 35% claim into a count: baseline, scopes, and methodology in one published document. The renewable purchases already made become measured reductions instead of asserted ones.
Brings the labeling language, the certification marks, and the reporting cadence onto one defensible line before the USDA complaint or a buyer questionnaire forces the sequencing.
